Dear Friends
The purpose of this article is not very happy ...
Under the circumstances occurred in a Central American country, Honduras, I have the duty to show you, in a brief analysis, because Latin America is the genesis of coups in recent years. The facts are very serious, global ignorance about them is even worse and influence "reborn" a powerful and paradoxically sector minority, that throughout history their only mission was to destroy the peace golden crystals.
Given that "Honduras is a rule of law, sovereign republic established as a free, democratic and independent to ensure its inhabitants the enjoyment of justice, freedom, culture and economic and social welfare" (Article I of the Constitution of Honduras), I want to prove what they are, in my view, the constitutional basis of condemning the actions of the coup Micheletti, president of the senate and president de facto. I can not deny that this reminds me of events in our history we live in Argentina in 1962.
oligarchs sectors opposed to the administration for them, former President Manuel Zelaya Rosales, who are also opposed to leaders like Hugo Chavez and Evo Morales, Latin American leaders accuse them of wanting to install a "neo-communist revolution" in that continent, and even point to Fidel Castro as the instigator of this purpose. As my admiration for the social state of law, applied by General Peron in 1946, is very strong, and far from being communist or Marxist, I wonder: How
Honduras is in compliance with the basic precepts of the dogmatic of its constitution?,
The army has the power to violate constitutional guarantees, and again at 70, covered in a cloak of legality completely fallacious?
"We went to war with the oligarchy and the Communists?
"Argentina, Brazil, Chile, Uruguay, Paraguay, Bolivia, Ecuador, Peru, etc etc etc ... Latin America is a continent communist?
How to explain the impossibility of impeachment for the president democratically elected, should be accurate the foundations of his overthrow?
in Honduras is not in default under the Constitution: Legal Foundations:
"Article 1 .- Honduras is a rule of law, sovereign republic established as free, democratic and independent to ensure its inhabitants the enjoyment of justice, freedom, culture and economic and social welfare."
Honduras is not a free republic, constitutional guarantees were abolished, and demonstrations are repressed constantly hindering free movement and expression .-..
"Article 2 .- The sovereignty of the people from whom emanate all branches of government are exercised by proxy.
impersonation of popular sovereignty and the usurpation of the powers that are typified as crimes of treason to their homeland. The responsibility in these cases is essential, and may be deducted automatically or on request of any citizen. "
The mass protests are demanding the return of their legitimate president .., the media operation of private media paid by the oligarchy that commands the coup was seen in the past days by the assistance of satellites and even reached the special meeting of the OAS.
Article 3 .- No one should obey a usurper government or to assume those functions or public for force of arms or using means or procedures that violate or fail to recognize what the Constitution and the laws. Acts by such authorities is zero. people have the right to resort to insurrection in defense of constitutional order.
This clearly looks like people are making use of what most Latin American constitutions called "right of resistance", a question that was grounded to the same Rousseau in his "Social Contract" ...
also the de facto government is violating:
Article 61 .- The Constitution guarantees the Hondurans and foreigners living in the country, the inviolability of life, personal security, liberty, equality before the law and property.
Article 62 .- The rights of man are limited by the rights of others, for the safety of all and by the just demands of the general welfare and advancement of democracy
("the rights of the poor majority are limited by those minority oligarchic coup?)
Article 63 .- The declarations, rights and guarantees listed in this Constitution shall not be construed as a denial of other claims, rights and guarantees not specified, which emanate from the sovereignty of the republican, democratic and representative government and human dignity.
Article 65 .- The right to life is inviolable.
ARTICLE 66 .- It is prohibited the death penalty.
68 .- Everyone has the right to respect for their physical, mental and moral.
Article 71 .- No person may be detained and held incommunicado for more than twenty-four hours without being brought to the order of competent authority for trial.
(disappearances are occurring far outweigh those 24 hours ..)
72 .- It is freedom to express views through any media without prior censorship. They are accountable to the law who abuse this right and those who direct or indirect means to restrict or prevent the communication and circulation of ideas and opinions.
82 .- The right of defense is inviolable. (IS STRONGLY DENIED ousted President)
Article 85 .- No person may be detained or imprisoned except in the places determined by law
limited to list what I consider most important, seen, and considering the brevity of my text and the numerous articles of the Honduran constitution
These are some of the legal grounds that show how and why the international community as expressed most totally repudiate the actions happen IN HONDURAS by coup. Join the discussions
